In many instances, senior citizens and their families make the decision that they move into nursing homes or long-term care facilities to ensure that they are well cared for, and will be protected from the effects of their deteriorating physical and/or mental conditions. In these settings, however, older people are sometimes actually physically and/or psychologically harmed by the negligent or intentional acts of their caregivers. Based on information available through the National Center on Elder Abuse, instances of nursing home abuse, caretaker abuse, health care provider neglect and elder exploitation continue to rise.

The most common manifestations of nursing home mistreatment and elder abuse are bedsores, falls (often resulting in serious injury), physical abuse, "walkways" (residents wandering off premises due to lack of proper care or supervision), and medication errors.

In institutional settings, several factors have been shown to contribute to this institutional elder abuse, including poorly qualified and inadequately trained staff, staff with a history of violence, inadequate numbers of staff, the isolation of residents, and the known reluctance of residents to report abuse out of embarrassment or fear.

Cases of nursing home litigation present several challenges. One of the most difficult issues to overcome is the tendency on the part of others, including insurance adjusters and even physicians, to discount an elderly person's injuries and the diminished quality of life that results from them.

Nursing homes owe a duty of care to residents. When the facility fails to meet that duty of care, they are liable for damages to the resident for the injuries they have sustained.
